These Terms of Service ("Terms") govern your use of the websites, tools, content, and
communications provided by Compact Cottages.
Compact Cottages is operated by Compact Cottages, LLC, a North Carolina limited liability
company, and Dirt and Sticks, Inc., a North Carolina corporation — two separate companies
that operate together under the Compact Cottages brand (together, "Compact Cottages," "we,"
"us," or "our"). These Terms apply to
compactcottages.com,
compactcottages.square.site,
avladu.com, and related pages, forms, and communications we operate (collectively, the
"Sites"), and to our SMS/text messaging program.
By accessing or using the Sites, submitting a form, checking a box that references these
Terms, or communicating with us, you agree to these Terms and to our
Privacy Policy. If you do not agree, please do not use
the Sites.
Compact Cottages provides information about our small-footprint homes, cottages, and ADUs, along with tools and services that may include home-design configurators, land-search assistance, financing referrals, site feasibility studies, and general contracting and real estate brokerage services in Western North Carolina and the Durham area.
All content on the Sites — including descriptions, plans, renderings, specifications, pricing estimates, availability, and timelines — is illustrative and provided for general informational purposes only. It may be incomplete, inaccurate, or out of date, may change without notice, and is not an offer, quote, guarantee, representation, or commitment of any kind. You should not rely on Site content in making decisions; consult appropriate professionals for advice specific to your situation.
Any construction, real estate brokerage, feasibility study, or other professional service we provide is governed by a separate written agreement signed by you and the applicable Compact Cottages company (Compact Cottages, LLC or Dirt and Sticks, Inc.). The terms of those signed agreements control over any general information on the Sites. Nothing on the Sites modifies, supplements, or creates rights under any such agreement.
Using the Sites, submitting a form, requesting information, or exchanging messages with us does not create any contractor-client, broker-client, agency, fiduciary, or other professional relationship between you and Compact Cottages. Such a relationship arises only upon a signed written agreement. Information provided through the Sites or in general communications is not financial, legal, real estate, engineering, or construction advice, and should not be relied upon as such.
Nothing on the Sites, and no email, text message, estimate, rendering, or other communication, creates, expands, or modifies any warranty regarding any home, structure, construction work, or service. Any warranty that applies to a home or service we provide is set forth solely and exclusively in the signed written agreement for that home or service. Statements about quality, durability, timelines, energy efficiency, or value made anywhere on the Sites are general marketing descriptions and are not warranties or guarantees.
Home-design configurators, calculators, feasibility information, pricing estimates, and land or property listings are provided for convenience only. Their outputs are estimates that may rely on third-party data (including multiple listing service data), and we do not guarantee that they are accurate, current, complete, or available. Land and property listings are subject to prior sale, change, or withdrawal without notice.
We may refer you to third-party lenders or financing partners at your request. We are not a lender, mortgage broker, or financial advisor; we do not provide financial or legal advice; and we do not guarantee approval, terms, or any financing outcome. Your relationship with any lender is solely between you and that lender.
By providing your mobile number to Compact Cottages and opting in, you agree to receive text messages from us related to your inquiry, your project, scheduling, and coordination.
You agree not to use the Sites to: violate any law; infringe the rights of others; submit false or misleading information; transmit harmful code; attempt to gain unauthorized access to our systems; or interfere with the operation of the Sites. We may suspend or terminate access for any misuse.
The Sites and their content — including text, graphics, logos, images, plans, and designs — are owned by or licensed to Compact Cottages, LLC and/or Dirt and Sticks, Inc. and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except for your own personal, non-commercial reference.
The Sites may include or link to third-party services, such as a home-design configurator, land-listing portals, financing partners, and payment processors. Those services are governed by their own terms and privacy policies. We are not responsible for third-party content, products, or practices.
Please read this section carefully. It affects your legal rights, including your right to go to court and to have a jury trial, and requires most disputes to be resolved by individual arbitration rather than in court or as part of a class action.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Sites, our text messaging or other communications, or our relationship with you — including claims under the Telephone Consumer Protection Act (47 U.S.C. § 227) and any other statutory, regulatory, common-law, or equitable theory — shall be resolved by final and binding individual arbitration administered by the American Arbitration Association under its applicable rules. The Federal Arbitration Act governs the interpretation and enforcement of this section.
You and Compact Cottages agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.
You and Compact Cottages waive any right to a trial by jury.
The arbitration shall take place in or near Asheville, North Carolina, or be conducted remotely, unless the parties agree otherwise. The arbitrator may not award damages greater than the limitations stated in these Terms. This section survives termination of your relationship with us and applies to claims arising before, during, or after that relationship.
You may opt out of this arbitration and class-action-waiver section by sending written notice to the contact address below within 30 days of first accepting these Terms, stating your name and your intent to opt out. Opting out will not affect any other part of these Terms.
If this entire arbitration section is found unenforceable, any dispute will be resolved exclusively in the state or federal courts located in Buncombe County, North Carolina, and you consent to their jurisdiction and venue.
The Sites and their content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the Sites will be uninterrupted, error-free, or secure, or that any estimate, tool output, or informational content will be accurate or produce any particular result, price, or timeline.
To the fullest extent permitted by law, Compact Cottages (including Compact Cottages, LLC and Dirt and Sticks, Inc.) and their officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of the Sites or these Terms, even if advised of the possibility of such damages. Our total aggregate liability for any and all claims relating to the Sites or these Terms will not exceed one hundred U.S. dollars (US$100).
Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law. This section does not apply to obligations under a separate signed agreement for construction or other services, which are governed by that agreement.
You agree to indemnify and hold harmless Compact Cottages (including Compact Cottages, LLC and Dirt and Sticks, Inc.) and their officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Sites, your violation of these Terms, or your violation of any law or the rights of a third party.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles, subject to the arbitration provisions in Section 11.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Sites after an update constitutes acceptance of the revised Terms.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Sites, and are separate from and subordinate to any signed agreement for our services. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
